The Legal Framework Governing Oxbury Warehouse Operations
01. Acceptance of Contractual Terms
By accessing the Oxbury Warehouse website or making a purchase at our physical showrooms in Brampton, London, or Windsor, you agree to be bound by these Terms of Service. This document constitutes a legally binding agreement between you (the Customer) and Oxbury Warehouse (the Company). These terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.
If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of our services. Your continued use of the website or the completion of a transaction signifies your absolute acceptance of these policies. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website, and it is your responsibility to check this page periodically for changes.
02. Eligibility and Age Requirements
To use our services or purchase appliances from Oxbury Warehouse, you must be at least the age of majority in the province of Ontario (18 years of age). By agreeing to these Terms of Service, you represent that you are at least the age of majority and that you have given us your consent to allow any of your minor dependents to use this site under your supervision. We do not knowingly collect data from or sell to individuals under the legal age.
Any transaction found to be initiated by a minor without parental consent may be voided at the discretion of the Company. Furthermore, you may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms will result in an immediate termination of your Services and potential legal action if damages occur.
03. Accuracy of Liquidation Pricing
At Oxbury Warehouse, we strive to provide the most competitive liquidation pricing in the Ontario market. However, despite our best efforts, typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, and availability may occur. We reserve the right to correct any errors and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice.
Pricing for our appliances is subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of a specific product or service. All prices are listed in Canadian Dollars (CAD), and applicable provincial and federal taxes will be added at checkout. Your receipt of an electronic order confirmation does not signify our acceptance of your order, but rather a confirmation that we have received it.
04. Inventory and "Open-Box" Disclosures
The core of our business is the sale of open-box, refurbished, and scratch-and-dent appliances. It is a fundamental term of service that the customer acknowledges the non-traditional nature of this inventory. Unlike brand-new-in-box items from standard retailers, our units may have been previously handled, displayed on a showroom floor, or returned due to minor cosmetic defects. We make every effort to disclose these conditions, but minor variations in condition are to be expected.
By purchasing an "Open-Box" or "Scratch-and-Dent" item, the customer agrees that they are satisfied with the physical condition of the unit as described or as seen in person. No claims for cosmetic damage will be accepted after the unit has been signed for and delivered. We maintain high standards for mechanical functionality, and while the exterior may have character, the internal components are tested to meet the rigorous performance standards expected of modern home appliances.
05. Modifications to the Service and Products
Oxbury Warehouse reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We are constantly updating our warehouse inventory based on available liquidations, which means that certain models, brands, or bundle offers may be available one day and gone the next. We are under no obligation to fulfill an order for a product that has been discontinued or removed from our active inventory.
We shall not be liable to you or to any third-party for any modification, price change, or discontinuance of an appliance model. While we attempt to maintain a consistent supply of popular brands like Samsung, LG, and Whirlpool, our stock is dependent on manufacturer liquidations. Consequently, we do not guarantee that a specific item viewed today will be available for purchase in the future. All quotes provided in-store are valid only for the duration specified by the sales representative.
06. User Account Security and Accuracy
If you create an account on our website to track your appliance purchases or warranty documents, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, or remove/edit content in our sole discretion if we suspect unauthorized access or fraudulent activity.
You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers/expiration dates, so that we can complete your transactions and contact you as needed. Failure to maintain accurate contact information may result in missed delivery windows or delays in processing warranty service requests.
07. Third-Party Links and Tools
Our website may provide you with access to third-party tools, such as delivery tracking software or financing calculators, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with Oxbury Warehouse. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.
08. Prohibited Uses of the Platform
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; or to infringe upon or violate our intellectual property rights or the intellectual property rights of others. This includes scraping our inventory data for use on competing websites.
You are also prohibited from uploading or transmitting viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden.
09. Intellectual Property Ownership
All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Oxbury Warehouse or its content suppliers and protected by Canadian and international copyright laws. The compilation of all content on this site is the exclusive property of Oxbury Warehouse, with copyright authorship for this collection by Oxbury Warehouse, and protected by international copyright laws.
You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. Using the "Oxbury Warehouse" brand name or logo to falsely imply a partnership or authorized dealership is strictly prohibited and will be met with legal action to protect our brand identity in Ontario.
10. Limitation of Liability
Oxbury Warehouse does not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. In no case shall Oxbury Warehouse, our directors, officers, employees, affiliates, agents, contractors, interns, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, or loss of data arising from your use of any of the service or any products procured using the service.
Because some provinces or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such provinces or jurisdictions, our liability shall be limited to the maximum extent permitted by law. Specifically, we are not liable for food spoilage, water damage from appliance failure, or clothing damage. Our total liability to you for any damages shall not exceed the amount you paid for the specific appliance in question.
11. Indemnification Clause
You agree to indemnify, defend and hold harmless Oxbury Warehouse and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
This indemnification extends to any issues arising from the improper installation of appliances by the customer or third-party contractors not affiliated with Oxbury Warehouse. If you choose to install a unit yourself, you assume all liability for ensuring it is done according to the Ontario building code. We will not be held responsible for damages to your home resulting from DIY installation errors or the use of improper connection hardware like old dryer vents or worn-out water hoses.
12. Severability of Terms
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions of this contract.
This ensures that the core of our business relationship remains intact even if one specific sub-clause is found to be inapplicable in a specific legal jurisdiction. Our goal is to maintain a fair and balanced set of rules that protects both the consumer and the company, and the severability clause is a standard legal protection to ensure the continued operation of our service policies under all circumstances.
13. Termination of Service Access
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail to comply with any term or provision of these Terms, we also may terminate this agreement.
Upon termination, you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). Termination does not void our warranty obligations for appliances already purchased, provided those units are within their coverage period and all other terms of the warranty have been met. We reserve the right to refuse service to anyone for any reason at any time.
14. Governing Law and Jurisdiction
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your purchase of an appliance from Oxbury Warehouse shall be resolved in the courts located in the judicial district of Peel (Brampton) or Middlesex (London).
By using our services, you waive any right to a trial by jury and agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. Our focus is on providing a local, community-based service to Ontario residents, and our legal framework is designed to reflect the consumer protection laws of our specific province while maintaining warehouse-level pricing standards.
15. Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party. This document, alongside your physical or digital invoice, represents the complete set of expectations for your purchase. No verbal promise made by a sales associate that contradicts these written terms shall be considered valid unless it is documented in writing and signed by an authorized manager of Oxbury Warehouse.
16. Product Representation and Photography
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. Furthermore, since many of our items are "one-of-a-kind" liquidation units, the photograph on the website may be a representative stock photo rather than the specific unit in our warehouse. We recommend visiting our showrooms for a physical inspection.
In cases where a specific dent or scratch is highlighted in a photograph, this is provided for your convenience but does not constitute an exhaustive list of all imperfections. By purchasing online without a physical viewing, you accept the risk that minor cosmetic variations may exist. However, we guarantee that the brand, model number, and core mechanical specifications will match the item you ordered exactly.
17. Sales Tax and Government Levies
All purchases are subject to the Harmonized Sales Tax (HST) of 13% as required by the Ontario government. In addition, certain appliances may be subject to environmental handling fees or provincial recycling levies, which will be clearly itemized on your final invoice. We are legally required to collect these taxes and fees and remit them to the appropriate government agencies, and as such, these amounts are non-negotiable.
If you are a tax-exempt entity (such as a registered charity or an indigenous person with a valid status card), you must present the appropriate documentation at the time of purchase to have the taxes removed from your invoice. We cannot refund sales tax after a transaction has been finalized and processed through our merchant systems. Please ensure all tax-related documentation is provided to your sales representative before payment is made.
18. Marketing and Communications Consent
By providing your email address and phone number during the checkout process, you consent to receive communications from Oxbury Warehouse regarding your order, delivery status, and warranty information. We may also send you promotional materials about upcoming liquidation events or seasonal sales. 19. Force Majeure
Oxbury Warehouse shall not be held liable or responsible for any failure or delay in performance of our obligations under these Terms of Service if such failure or delay is caused by circumstances beyond our reasonable control. This includes, but is not limited to, acts of God, war, strikes or labor disputes, embargoes, government orders, pandemics, or disruptions in the global appliance supply chain or local logistics networks.
In such events, we will make every reasonable effort to notify affected customers and reschedule deliveries or service appointments as soon as conditions allow. We appreciate your understanding during times of regional or global disruption. Our commitment to our customers remains firm, but the safety of our staff and the feasibility of logistics must be prioritized during "Force Majeure" events as defined by Ontario law.
